12-MONTH LIMITED WARRANTY (VALID IN THE UNITED STATES ONLY)

WHAT DOES THIS WARRANTY COVER?

This warranty covers any defects or malfunction in your new product from The First Years brand.

HOW LONG DOES THE COVERAGE LAST?

12 months after the date the Product was delivered to you. Coverage terminates if you sell or otherwise transfer the Product.

WHAT WILL TOMY DO?

TOMY International, Inc. (“TOMY,” “we,” “our” and “us”) will, at our option, either: (i) replace the Product that proves to be defective in materials or workmanship with the new Product; or (ii) replace such a defective product with a product of comparable value at no charge.

WHAT DOES THIS WARRANTY NOT COVER?

Any problem that is caused by damage in transit, inadequate care or neglect, abuse, abnormal use, misuse, alteration, accidents, normal wear and tear, damage due to environmental or natural elements, failure to follow product instructions, immersion in water (except for products specifically identified by us in writing as intended for water use), battery leakage or improper installation, improper storage or maintenance of the Product, or improper service or causes not arising out of defects in materials and workmanship.

LIMITATIONS OF WARRANTY AND YOUR RIGHTS UNDER STATE LAW

THIS WARRANTY IS MADE EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ALL OTHER OBLIGATIONS ON THE PART OF TOMY, PROVIDED, HOWEVER, THAT IF THE DISCLAIMER OF IMPLIED WARRANTIES IS INEFFECTIVE UNDER APPLICABLE LAW, THE DURATION OF ANY IMPLIED WARRANTIES ARISING BY OPERATION OF LAW SHALL BE LIMITED TO TWELVE (12) MONTHS FROM THE DATE THE PRODUCT WAS DELIVERED TO YOU OR SUCH LONGER PERIOD AS MAY BE REQUIRED BY APPLICABLE LAW. TOMY HEREBY DISCLAIMS ANY AND ALL LIABILITY FOR CONSEQUENTIAL AND INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH ANY BREACH OF ANY WARRANTY OR ANY OTHER CLAIM WITH RESPECT TO THE PRODUCT, INCLUDING WITHOUT LIMITATION CLAIMS OF NEGLIGENCE, STRICT LIABILITY IN TORT OR BREACH OF CONTRACT. SOME STATES DO NOT ALLOW (I) LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR (II) THE EXCLUSION OR LIMITATION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
